What the 2015 Healthy Workplace Bill addresses in a nutshell.....

 

This act addresses Workplace Bullying, Mobbing, and Harassment, without regard to protected class status.  It was authoried by Professor of Law, David Yamada, Suffold University Law School, Boston, MA.  The Bill has 9 sections.

 

Section 1 is a Preamble.  It lays out all of the reasons that this bill is needed.  For a list of some of the reasons that this bill is needed go to our "Learn More" section and see the page called "Why This Bill Is Needed."

 

This section also explains the purpose in that it is intended to provide legal relief for employees who have been harmed, psychologically, physically, or economically, by deliberate exposure to abusive work environments and to provide incentive for employers to respond to and prevent mistreatmeant of employees at work. 

 

Section 2 provides important definitions that are required to fully understand the intent of the bill.  Included is a decription of what constitutes an abusive work environment, abusive conduct, psychological harm, physical harm, adverse employment action and constructive discharge. 

 

Section 3 lays out what constitutes unlawful employment practices to includes what is an abusive work environment and retaliation.

 

Section 4 specifies and employer liability and defenses

 

Section 5 specifies eEmployee liability and defenses

 

Section 6 speaks to affirmative Defenses

 

Section 7 speaks to general relief and limitations on employer liability.

 

Section 8 provides procedures for private right of action and time limitations.

 

Section 9 specifies the effect on other legal relationships
